These Terms of Service ("Terms") govern your access to and use of FleetClear (the "Service"), operated by 9GG LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA ("FleetClear", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
FleetClear is a software tool that helps owner-operators and small fleets track due dates for DOT/FMCSA compliance items — operating authority (MC/USDOT), UCR, IFTA, IRP, driver medical cards, annual inspections, MCS-150 updates, insurance filings and Clearinghouse queries — and that drafts and dispatches deadline-action notices and filing checklists at configurable thresholds (e.g. 60, 30 and 7 days before the due date). FleetClear tracks deadlines and drafts checklists; it is not legal or DOT-compliance advice. You are responsible for verifying all requirements and deadlines with FMCSA or your state. You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must verify your email address to activate your account. You must be at least 18 and authorized to bind your organization.
You agree not to misuse the Service, including: reverse engineering, interfering with or disrupting the Service, accessing it by unauthorized means, uploading unlawful content, or using it to send unsolicited or unlawful communications. You are responsible for the content of any notices you configure the Service to send and for compliance with applicable anti-spam laws (including the CAN-SPAM Act, CASL and similar).
You retain all rights to the data you submit ("Customer Data"). You grant us a limited licence to process Customer Data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy.
The Service relies on third parties, including Stripe (payments), Resend (email delivery), AI/LLM providers (renewal-notice drafting) and our hosting provider. Your use may be subject to their terms. We are not responsible for third-party services.
The Service, including its software, design and content (excluding Customer Data), is owned by FleetClear and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALERTS OR DRAFTS WILL BE COMPLETE, ACCURATE OR TIMELY. YOU REMAIN SOLELY RESPONSIBLE FOR YOUR COMPLIANCE OBLIGATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEETCLEAR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY MISSED DEADLINE, LAPSED CREDENTIAL, FINE OR LOST BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
You will indemnify and hold FleetClear harmless from claims arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination, your right to use the Service ends; we may delete Customer Data after a reasonable period as described in the Privacy Policy.
We may update these Terms from time to time. Material changes will be notified by email or in-product. Continued use after changes take effect constitutes acceptance.
